Thank you for using Listnly (“Listnly,” “we,” “us,” or “our”). Your privacy and trust are important to us. This Privacy Policy describes how we collect, use, disclose, and protect your personal information when you use our website, mobile application, and related services (collectively, the “Service”).

By using Listnly, you agree to the terms of this Privacy Policy. If you do not agree, please do not access or use the Service.

Scope of This Policy

This Privacy Policy applies to all personal information we collect about you when you use the Service, communicate with us, or otherwise engage with Listnly online. It also explains your privacy rights under applicable law, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA).

This Policy does not apply to:

Information collected by third-party websites or applications that may link to or be accessible from the Service; or
Information collected offline or through other unrelated channels.

Information We Collect

We collect both Personal Information (data that identifies you or can reasonably be linked to you) and Non-Personal Information (data that cannot identify you).

Note: Conversations between Users and Listeners are designed to be anonymous. You are not required to provide personally identifying information during sessions.

Non-Personal and Technical Data

We may automatically collect usage and diagnostic data such as:

App performance metrics and crash reports
Aggregated analytics data
Language and system settings

If we combine non-personal data with information that identifies you, we treat it as personal information.

How We Collect Information

We collect information from three main sources:

Directly from You: When you register an account, contact support, or provide feedback.
Automatically: Through cookies, log files, analytics tools, and similar technologies.
From Service Providers: Such as hosting or analytics partners who help operate our platform.

You can control or disable cookies through your browser settings, though doing so may limit certain features.

How We Use Your Information

We use your personal information for the following business purposes:

To provide, maintain, and improve the Listnly platform;
To facilitate user-listener interactions;
To personalize your experience and remember preferences;
To detect, investigate, and prevent fraud or abuse;

For any other purpose disclosed to you at the time of collection or with your consent.

We do not use or disclose sensitive personal information for any purpose that would require a right to limit under California law.

Disclosure of Information

We do not sell or share your personal information as those terms are defined under the CCPA/CPRA.

We may disclose your personal information only to:

Service Providers: Who help us operate, host, or support the Service under written contracts limiting their use of your data.
Legal and Safety Purposes: To comply with law, court orders, or to protect our rights and the safety of users.
Business Transfers: In connection with a merger, acquisition, or sale of assets, where personal data may be transferred as part of the transaction.
With Your Consent: When you explicitly authorize disclosure.

We do not disclose your personal information to third parties for cross-context behavioral advertising or targeted advertising.

Retention of Information

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and maintain system integrity. Once retention is no longer required, information is securely deleted or deidentified.

We will respond within 45 days of receiving your verified request (with a possible 45-day extension if reasonably necessary). We will verify your identity before responding to protect your information.

Authorized agents may submit requests on your behalf if they provide written proof of authorization.

We use cookies and similar technologies to:

Maintain session functionality;
Analyze Service usage and performance;
Improve user experience.

You can set your browser to block cookies or alert you when cookies are being used. Note that disabling cookies may limit the functionality of certain Service features.

Children’s Privacy

Listnly is intended for individuals 18 years of age or older. We do not knowingly collect or solicit data from minors. If we learn we have collected information from anyone under 18, we will promptly delete it.

We employ administrative, technical, and physical safeguards to protect your information, including:

Access controls and authentication;
Regular security assessments and monitoring.

Despite our efforts, no system can guarantee absolute security. You use the Service at your own risk.

We may update this Privacy Policy periodically. The “Last Updated” date reflects the most recent revision. We will notify you of significant changes by posting an updated notice on our website or mobile app, or by email if appropriate. Continued use of the Service after an update constitutes acceptance of the revised Policy.

California Notice at Collection

Under California law, we are required to inform consumers at or before the point of data collection about the categories of personal information we collect and the purposes for which they will be used.

We collect the following categories of personal information:

Identifiers (e.g., name, email, IP address)
Internet/network activity (e.g., browsing, app usage)
Device and technical data
Limited geolocation data (general region only)

We use this information for the purposes described in Section 4 above. We do not sell or share personal information, nor do we collect or use sensitive personal information beyond legally permissible limits.

No Sales or Sharing of Personal Information

We do not currently “sell” or “share” personal information as those terms are defined by the CCPA/CPRA (including cross-context behavioral advertising). If this changes, we will update this Policy and our consent banner.

We will not use any opt-out data for purposes other than honoring your request.

Global Privacy Control (GPC)

If your browser or extension sends a Global Privacy Control (GPC) signal, we will treat it as a valid opt-out of sale/sharing for that browser.

If you are logged in, we will make commercially reasonable efforts to bind the signal to your account preferences as well.
Some features may rely on cookies; disabling them may limit functionality.

Opt-Out Requests via Authorized Agent & Verification

You may designate an authorized agent to submit a request on your behalf. We will require:

A signed authorization from you, and
Verification of your identity (or direct confirmation from you to us).

For your own requests, we may ask for reasonable information to verify that you are the account holder (e.g., access to the registered email). We do not require you to create an account to submit a request.

We will confirm receipt within 10 business days and respond within 45 days (with one 45-day extension if reasonably necessary).

Limiting Use of Sensitive Personal Information

We do not intentionally collect or use Sensitive Personal Information (as defined by CPRA) for the purpose of inferring characteristics or for any secondary purpose requiring a right to limit. If that changes, we will provide a “Limit the Use of My Sensitive Personal Information” control and update this Policy.

Notice of Financial Incentive (if applicable)

We currently do not offer a financial incentive program (e.g., paid loyalty, discounts in exchange for data). If we introduce one, we will provide a separate Notice of Financial Incentive describing material terms, categories of data involved, how to opt in, and how to withdraw.
